These Terms of Service ("Terms") govern your use of arisi.com and your purchase of products from Osher Enterprises Inc, operating as Arisi ("Arisi", "we", "us"). By using the site or placing an order you agree to these Terms.
Products, pricing, and orders
All prices are in United States dollars and include free standard shipping to the United States, with customs duties prepaid by us. We work hard to display our products accurately; colors may render differently on different screens, and small variations are the nature of washed denim. We may correct pricing or descriptive errors, and we may refuse or cancel any order, including where an error occurred, where fraud is suspected, or where a discount was misused; if we cancel a paid order, we refund it in full. Placing an order is an offer to purchase; the contract forms when we confirm dispatch.
Discounts, credits, and offers
Automatic bundle savings apply in the cart as described at the time of purchase. Discount codes are single use, cannot be combined with bundle savings or other codes, and have no cash value. Founding credits are single use codes that expire six months after issuance, cannot be redeemed for cash except where the law requires, and apply to full price merchandise. We may modify or end any offer prospectively at any time.
Shipping, risk, and returns
Delivery estimates are set out in our Shipping Policy and run from dispatch. Risk of loss passes to you on delivery to your address. Returns and exchanges are governed by our Refund Policy, published on this site, which is part of these Terms.
Intellectual property and site use
The Arisi name, logo, product names, photography, and all site content belong to Osher Enterprises Inc or its licensors and may not be used without written permission. You agree not to misuse the site, interfere with its operation, or use it for any unlawful purpose.
Disclaimers and limitation of liability
The site and products are provided as available. To the fullest extent the law allows, we disclaim warranties not expressly stated, and our total liability for any claim arising from a purchase is limited to the amount you paid for the product concerned. Nothing in these Terms limits rights that consumer law does not allow to be limited.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules.
Arbitration and class action waiver
Please read this section carefully; it affects your legal rights. Before starting arbitration, you agree to send a written description of the dispute to hi@arisi.com and to give us thirty days to resolve it informally; we owe you the same step before starting arbitration against you. Any dispute that is not resolved informally and that arises out of or relates to these Terms, the site, or a purchase will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. The arbitration will take place in Miami, Florida, or, at your election, by videoconference or telephone, and the arbitrator may award the same relief a court could award to you individually. You and Arisi each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or any other representative proceeding. If twenty five or more demands presenting common issues are filed by or with the coordination of the same counsel or organization, you and Arisi agree that the demands will be administered in staged batches of up to fifty, each batch before a single arbitrator, before any remaining demands may proceed. You may opt out of this arbitration agreement by writing to hi@arisi.com within thirty days of your first purchase, stating your name, your order number, and your intent to opt out. If the class action waiver is found unenforceable as to a particular claim, that claim, and only that claim, will proceed in court.
